Visa Bulletin for June 2026

U.S. Department of State | Litwin & Smith Immigration Law Update

The U.S. Department of State has released the Visa Bulletin for June 2026 (Volume XI, Number 15). The Visa Bulletin governs the availability of immigrant visa numbers for both the National Visa Center (NVC) process and adjustment of status filings with USCIS. Each month, USCIS separately announces whether applicants may use the “Dates for Filing” chart or must instead rely on the “Final Action Dates” chart to determine filing eligibility.

For June 2026, USCIS has announced that family-sponsored applicants may use the Dates for Filing chart, while all employment-based applicants must use the Final Action Dates chart.

USCIS Adjustment of Status Filing Instructions — June 2026

Family-Sponsored Categories: Applicants in all family-sponsored preference categories may use the Dates for Filing chart.

Employment-Based Categories: All employment-based preference categories must use the Final Action Dates for filing. However, there are two notable exceptions for EB-1:

  • EB-1 China: Applicants with priority dates before December 01, 2023, may file for adjustment of status.
  • EB-1 India: Applicants with priority dates before December 01, 2023, may file for adjustment of status.

EB-4 Religious Workers (SR): Under the Dates for Filing chart, SR petitions filed before January 15, 2023, are eligible to file for adjustment of status. Under the Final Action Dates chart, the cutoff is July 15, 2022.

Final Action Dates — Employment-Based

“Current” means visas are available for all applicants in that category and country. A date means visas are available only for applicants whose priority date is earlier than the date shown.

Key Notes — Employment-Based

  • EB-1 India Retrogression: High demand has necessitated retrogressing the EB-1 India Final Action Date to December 15, 2022. Further retrogression — or the category becoming “Unavailable” — is possible before the end of FY 2026.
  • EB-2 China Warning: Significant demand may require retrogression or suspension of the EB-2 China Final Action Date in the coming months.
  • EB-3 Philippines Warning: Similar demand pressures may necessitate retrogression of the EB-3 Philippines Final Action Date.
  • EB-5 Unreserved India Warning: Demand may require retrogression of the EB-5 unreserved Final Action Date for India in the coming months.
  • EB-5 Set-Aside Categories: All EB-5 Set-Aside categories (Rural, High Unemployment, and Infrastructure) remain Current for all countries.

Broader Context: Reduced Issuance Rates and Potential Retrogression

The Department of State has noted that immigrant visa issuance rates for nationals of certain countries have declined as a result of various administration actions taken for national security and public safety purposes, including Presidential Proclamations issued in 2025. To make full use of available visa numbers, the Department has advanced cutoff dates across multiple categories in prior months. Applicants should be aware that retrogression — or categories being declared “Unavailable” — remains possible before the end of FY 2026 (September 30, 2026) if per-country or category limits are reached.
